Update - excessive hours payment for members in receipt of commuted overtime

As members are aware, a number of disputes have arisen from the excessive hours payment payable to members on the commuted overtime allowance.   

Following negotiations directly with The Force and conciliation processes in the Australian Industrial Relations Commission, two significant issues remained in dispute: 

·        After how many continuous hours of work should an excessive hours allowance be paid; 

·        At what rate should the allowance be paid. 

The matter was referred to the AIRC for arbitration and the hearing was held on 4, 5 & 6 of June.  At the conclusion of the hearing, Deputy President Hamilton reserved his decision. 

Members will be advised of the outcome when Deputy President Hamilton hands down his decision.  In the interim, members should be applying for the excessive hours penalty after 12 hours of continuous work and recording the details of any rejection.
